Michigan recognizes that young adults do make mistakes that shouldn’t destroy their future or their ability to become successful members of society. Under these same laws, this act acknowledges that an individual between the ages of seventeen and twenty one can greatly benefit from a “second chance.” To avoid educational and financial issues, HYTA can ensure an individual’s freedom and future that are fully protected. No record, conviction or negative consequence will allow them to achieve this. This act was written to avoid felony and misdemeanor charges on his/her permanent record. If completed, various terms of probation and compliance with specific court demands can dismiss all charges and evidence such as, arrest records or finger print records.

(1)     if an individual pleads guilty to a criminal offense, committed on or after the individuals seventeenth birthday but before his or her twenty-first birthday, the court of record having jurisdiction of the criminal offense may, without entering a judgment of conviction and with the consent of that individual, consider and assign that individual to the status of youthful trainee.

The individual must plead guilty and accept responsibility for their actions and complete the youthful trainee probationary term successfully. Certain crimes such as; imprisonment of life (murder/kidnapping), major controlled substance offenses, traffic offenses and sex crimes are not permitted in Holmes Youthful Training Act (HYTA) status. The prosecutor does not have consent in order for HYTA, whereas the judge has full discretion. The judge cannot order more than three years of probation, but can include an incarceration as part of its sentence. Picking up any new charges while on probation/failing any drug tests or otherwise failing to comply with the judges orders’, they will have to reappear in front of the judge as charged with a probation violation, following with the individuals HYTA status being revoked.
